The MTN eShop ("eShop") is an enterprise-wide eCommerce platform established by MTN Nigeria Communication PLC to consolidate the shopping experience of Customers for its products (tangible and intangible) and services.
These Terms and Conditions govern your relationship with us and specify how you are permitted to access and use the Service. Your use of the Service is subject to your acceptance without modification of the terms, conditions, and notices contained in these Terms and which form part of these Terms. If you disagree with these Terms or any part thereof, you are expressly prohibited from using eShop and you must discontinue immediately.
The following terms shall have the specific meanings assigned to them in these Terms and Conditions:
"Customer", "you" and "your" refers to you, the person using this Service and accepting the Terms and Conditions.
"MTN/we/us/our", refers to MTN Nigeria Communications PLC.
"Personal Information" shall refer to any information relating to an identified or identifiable natural person, including those identified under clause 13 and as defined under the Nigerian Data Protection Regulation.
"Privacy Policy" shall refer to MTN’s privacy policy which is accessible at https://shop.mtn.ng/privacy-policy-cookie-restriction-mode/
"Service" refers to MTN eShop and all other services connected to eShop.
"Terms" shall refer to these terms and conditions.
You agree that the use of the eShop constitutes Your acceptance of these Terms. These Terms form a binding legal agreement between you and MTN with respect to the use of eShop. All requirements within these Terms will be strictly enforced. Therefore, please ensure you understand and agree to be bound by these Terms. Also, note that MTN reserves the right to refuse service or access to eShop to anyone for any reason and at any time.
By using eShop, you represent and warrant the following:
2.1. All registration information you submit will be true, accurate, current and complete;
2.2. You will maintain the accuracy of such information and promptly update such registration information as necessary;
2.3. You have the legal capacity and you agree to comply with these Terms.
2.4. You will not use eShop for any illegal or unauthorised purpose.
2.5. Your use of eShop will not violate any applicable law or regulation.
2.6. If you provide any information that is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of eShop (or any portion thereof).
3.1. In order to use eShop, you must create an account and provide accurate and complete registration information such as your email address/user ID/Phone number, and password.
3.2. You are solely responsible for maintaining the confidentiality of your login credentials, and you are fully responsible for all activities that occur under your account. You shall not grant the rights over your account to any third party. If you provide permission to any third party to manage your account on your behalf this shall be at your own risk.
3.3. You must notify MTN immediately of any unauthorised use of your account or any other breach of security.
3.4. We may suspend or cancel your account at any time in our sole discretion and without notice or explanation providing that if we cancel any products or services you have paid for but not received and you have not breached these Terms, we will refund you in respect of the same.
MTN grants you a limited, revocable, non-transferable, non-sub-licensable, non-exclusive licence to access and use eShop (including any updates or upgrades) via the website https://shop.mtn.ng/ for your personal use, for non-commercial purposes only and subject to these Terms. The licence is limited to you alone and cannot be transferred by you to a third party.
Internet access is necessary to use, access, or view eShop. Any fees your service provider or other third parties may charge you for utilizing data, phone, or text services while using the Service are your responsibility.
We make every effort to provide accurate and complete descriptions of our products and services. However, MTN does not warrant that the descriptions, prices, or any other content on eShop are accurate, complete, reliable, current, or error-free and your electronic display may not accurately reflect the actual colours and details of the products and services. In the event of an error or inaccuracy, MTN reserves the right to correct the error and revise the content accordingly or otherwise.
All products and services are subject to availability, we cannot guarantee that items will be in stock. We reserve the right to discontinue any products or services at any time for any reason.
The eShop accepts payments through the payment gateway card, bank transfer, NQR (Nigeria Quick Response), USSD and Mobile Money (“MoMo”). For non-tangible products and services, payments can be made through the aforementioned payment methods including the use of MTN airtime.
Currently, we do not offer payment on delivery as a payment option. We require all payments to be made through eShop prior to the delivery of any products or services.
We reserve the right to change the payment method at any time without notice to you.
MTN may provide you areas on eShop to leave reviews or ratings. When posting a review, you must comply with the following criteria:
9.1. You should have first-hand experience with the product being reviewed.
9.2. Your reviews should not contain profanity, abusive, offensive, or hateful language or contain references to illegal activity.
9.3. You should not be affiliated with competitors (i.e. key employees, brand ambassadors, and partners of a competitor) if posting negative reviews.
9.4. You shall not post any false or misleading statements.
9.5. We may accept, reject or remove reviews in our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate.
9.6. Reviews are not endorsed by us, and do not represent our opinions or the views of any of our affiliates or partners.
9.7. MTN shall not assume liability for any review or for any claims, liabilities, or losses resulting from any review.
9.8. By posting a review you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free, fully paid assignable and sublicensable right and licence to reproduce, modify, translate, transmit by any means, display, perform and/or distribute all content relating to the review.
You may not access or use eShop for any purpose other than that for which we make the Services available. eShop may not be used in connection with any commercial activities except those that are specifically endorsed or approved by MTN.
As a user of eShop, you agree not to:
11.1. Systematically retrieve data or other content from eShop to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from MTN.
11.2. Notwithstanding section 11.1 you may forward links to products on our eShop and redistribute our newsletter and promotional materials in print and electronic form to any person.
11.3. Circumvent, disable, or otherwise interfere with security-related features of eShop, including features that prevent or restrict the use or copying of any content or enforce limitations on the use of eShop and/or the content contained therein.
11.4. Use any information obtained from eShop in order to harass or abuse other Customers or any person.
11.5. Upload or transmit (or attempt to upload or to transmit) viruses, trojan horses, spamming or other material that interferes with any Customer’s uninterrupted use and enjoyment of eShop or modifies, impairs, disrupts, alters or interferes with the use, features, functions, operation or maintenance eShop.
11.6. Attempt to impersonate another Customer or person or use the username of another Customer.
11.7. Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing services to you on eShop.
11.8. Interfere with, hack, disrupt or create an undue burden on eShop or the networks or services connected to eShop.
11.9. Attempt to bypass any measures designed to prevent or restrict access to eShop or any services connected to eShop.
11.10. Except as permitted by appliable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up part of eShop.
11.11. Use eShop as part of any effort to compete with MTN or otherwise use eShop and/or the content for any revenue-generating activity or commercial enterprise.
11.12. Make any unauthorised use of eShop, including collecting usernames and/or email addresses of other customers by electronic or other means of the purpose of sending unsolicited email or creating user accounts by automated means or under false pretences.
eShop, all related trademarks, logos, taglines, trade names, copyrights, and all other intellectual property assets, right(s), and features within eShop are protected by intellectual property rights belonging to MTN or to its licensors. No license is granted under this agreement in respect of any such rights.
MTN provides eShop for non-commercial, non-exclusive, non-transferable, restricted personal use and eShop may be used for no other purpose without the prior written consent of MTN.
MTN may collect certain Personal Information which is required and appropriate for the use of EShop. Such information shall include your name, location, mailing address, phone number and email address. All personal information shall be stored, processed and dealt with in line with MTN’s Privacy Policy at https://shop.mtn.ng/privacy-policy-cookie-restriction-mode/, the Nigerian Data Protection Regulations and any other applicable extant regulations.

MTN reserves the right but not the obligation to do the following:
14.1. Monitor eShop for violations of these Terms;
14.2. Take appropriate legal action against anyone who in our sole discretion, violates the law or these terms, including without limitation, reporting such user to law enforcement authorities;
14.3. In our sole discretion and without limitation, notice, or liability, to remove from eShop or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems.
14.4. Manage eShop in a manner designed to protect our rights and property and to facilitate the proper functioning of eShop.
These Terms shall remain in full force and effect while you use eShop. Without limiting any other provision of these Terms, we reserve the right to in our sole discretion and without notice or liability, deny access to and use of eShop to any person for any reason or for no reason, including without limitation for breach of any representation, warranty or covenant contained in these Terms or any applicable law or regulation. MTN may in its sole discretion, terminate your use of eShop or delete your account and any content or information that you posted at any time without warning.
If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party.
We reserve the right to change, modify, or remove the contents of eShop at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on eShop. We also reserve the right to modify or discontinue all or part of the services on eShop without notice at any time. We will not be liable to you or any third party for any modification, price changes, suspension or discontinuance of the services connected to eShop.
We cannot guarantee eShop will always be available. We may experience hardware, software or other problems or need to perform maintenance on eShop, resulting in interruptions, delays or errors. You agree that we have no liability whatsoever for any loss, damage or inconvenience caused by your inability to access or use eShop during any downtime or discontinuance.
There may be information on eShop that may contain typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on eShop at any time without prior notice.
Every information, content or incident related to the use of the eShop ("Confidential Information") shall be treated with the utmost secrecy and confidentiality by you. Except where authorized by MTN in writing, you shall not disclose such Confidential Information) to any third party whatsoever.
Where Confidential Information is released to or accessed by you in accordance with the requirements as provided above, you shall take all reasonable precautions to preserve the integrity and prevent any corruption or loss, damage or destruction of data and Confidential Information; except to a third party who is bound by a similar confidential obligation and upon prior written authorization of MTN.
The provision of this clause 17 shall continue to apply even after your use of the eShop. You shall erase or cause to be erased all Confidential Information and data provided by MTN. You shall provide written confirmation of the deletion to MTN.
Additionally, if so required by law or valid legal or regulatory process, you may disclose such Confidential Information, but only by providing notice to MTN of the requirement to disclose and reasonable cooperation with any attempt by MTN to maintain the confidentiality of such Confidential Information.
